Available Van Rules to Sell Your vehicle

By listing your vehicle for sale through the Available Van’s Sell Your Van experience, you acknowledge and agree that: (a) the vehicle you list for sale is in your possession; (b) you have the right to transfer the advertised vehicle’s title to the purchaser; (c) you are willing to sell the advertised vehicle at the price and on any other terms specified in your listing; (d) you will purchase only one listing per unique vehicle and you will not advertise more than one vehicle in a single listing, either by including descriptions of multiple vans in one listing or by subsequently updating the listing information to advertise different vehicles; (e) upon selling or otherwise taking your vehicle off the market, you will within 72 hours delete the listing for that vehicle; (f) you will not use your listing to advertise or promote anything (including, without limitation, any product, service or business) other than one unique vehicle offered for sale; (g) you will owe Available Van for your Sell Your Van listing, even if you fail to sell your vehicle or are dissatisfied with the Sell Your Van experience; (h) you will properly identify yourself as either an “Individual Seller” or a “Dealer” (a “Dealer” is any individual or entity that is in the business of selling vehicles or who has had 4 or more vehicles for sale on the Available Van site within the previous 12 months of the listing start date; anyone that does not meet the definition of a Dealer is an “Individual Seller”); (i) Neither an “Individual Seller” or a “Dealer” may list 4 or more Free, Plus, or Premium ads during a single calendar year. A “Dealer” may list an unlimited amount of Single Dealer Ads; (j) if you placed a listing with a material error that cannot be corrected through the Available Van provided tools, you will contact Available Van customer service within 10 days of your original listing date to inquire about making material changes to your listing (e.g., through a typographical error, you listed the wrong model for sale) and Available Van shall determine, in its sole discretion, whether such changes will be permitted; (k) you will not use the Available Van site, including without limitation your Sell Your Van listing, for any fraudulent, false, misleading or deceptive activity; (l) all content and information that you provide to Available Van is truthful, accurate and complete; and (m) you have the full right, title and interest in and to all content, photos and other material that you provide to, or post on, Available Van; (n) photos provided for the Sell Your Van listing will only show the vehicle listed for sale and may not include under any circumstances people, animals, or other objects not part of the vehicle. Available Van reserves the right, in its sole discretion, to remove any Sell Your Van listing or photo, without notice and without liability or providing a refund, that does not meet the requirements of these Sell Your Van Terms & Conditions, Available Van website Terms of Service, Available Van policies, or if Available Van otherwise determines or believes, in Available Van sole and exclusive discretion, that your listing or any photo or other content you upload is inappropriate for any legal, business, technical or other reason.

Listing Details

Currently, Available Van offers various listings packages. Features included are:

Run time: The number of days at a time the listing appears on the Available Van site.

Renewals: Sell Your Van listings are able to be renewed and re-listed on the site. The opportunity to renew will be made available 7 days before an ad expires and 30 days after an ad expires.

Photos: Available Van Sell Your Van listings can include from 0-100 photos of the seller’s actual vehicle.

GENERAL LIMITATIONS. At this time, Available Van Sell Your Van listings can only be created for the vehicles and models specifically identified in the Build Your Ad Form drop-down menus. You are solely responsible for the information, content, and photos contained within your Sell Your Van listings. Sell Your Van listings only contain the features expressly indicated. In some cases, different features are available to other Available Van advertisers (including but not limited to “Certified Pre-Owned” logos) that are not available to you. Available Van’s Sell Your Van listings may not appear on the Available Van site for up to 72 hours. Available Van DOES NOT MAKE AND EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES TO YOU REGARDING THE SELL IT YOURSELF SERVICE, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES THAT YOU WILL SELL YOUR VEHICLE, OBTAIN AN ACCEPTABLE PRICE FOR YOUR VEHICLE, ONLY RECEIVE LEGITIMATE INQUIRIES OR SOLICITATIONS FROM QUALIFIED BUYERS, OR RECEIVE ANY INQUIRIES REGARDING YOUR VEHICLE FOR SALE.

Available Van reserves the right to, but is under no obligation to and does not assume any obligation to, review Sell Your Van listings before and/or after they are posted to the Available Van site to confirm information relating to the advertiser and the advertised vehicle and to investigate complaints and suspicious activity. If Available Van determines, in its sole and exclusive discretion, that you are engaging in any unfair, deceptive, false, misleading or fraudulent practices, Available Van reserves the right to reject or immediately remove your listing from the Available Van site without notice and without liability or providing a refund, as described above.

Sell Your Van Standard Refund Policy

As a general matter, Available Van does not provide refunds for Sell Your Van listings more than 24 hours after a listing is purchased except under the following circumstances: (a) if it took longer than 72 hours for your listing to be posted to the Available Van site OR (b) if you mistakenly purchased (either through the Available Van site or through one of Available Van’s newspaper or broadcast affiliates) a duplicate listing for the same vehicle and both appear on the Available Van site at the time of your request. In order to be eligible to receive a refund under these two circumstances, Available Van must receive your refund request in the manner described below within 5 calendar days of your purchase of a Sell Your Van listing.

Available Van further reserves the right to make refunds at any time in connection with cases of fraud, abuse, and in other limited instances. Available Van does not provide refunds under any other circumstances. Notwithstanding anything in this policy to the contrary, Available Van reserves the right to finally determine in its sole discretion whether the criteria for a refund set forth in this policy have been satisfied and to request any additional information relevant to such request.

All refund requests must be in writing and include your name, address, e-mail address, ad ID, vehicle description, the last 4 digits of the credit card used to purchase the listing, and the reasons you are requesting a refund. Available Van is not responsible for refund requests that are not timely received in accordance with this policy for any reason, including without limitation, Web congestion, addressing mistakes, computer or Internet downtime, or requests submitted by phone, postal mail, or any other manner not expressly provided for in this policy.

NOTE: The Sell Your Van Standard Refund Policy applies to online-only Sell Your Van listings, as defined above, purchased on the Available Van site. The Sell Your Van Standard Refund Policy does not apply to any listings that are purchased from one of Available Van’s newspaper or other affiliates or partners as part of a print/online bundled package, even if such listings appear on the Available Van site.

Available Van reserves the right to modify this Refund Policy at any time.
